Terms of Service

LOKA Platform is operated by Socratus Collective Wisdom Corporation, a corporation organized under the laws of the United States.

These Terms of Service ("Terms") govern your access to and use of the LOKA platform. By accessing or using LOKA, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Nature of the Service

LOKA uses artificial intelligence systems to suggest tags, generate metadata, moderate content, detect abuse, and rank or surface content.

8. Physical World Disclaimer

LOKA operates in connection with real-world locations. LOKA does not verify access rights to locations, does not endorse physical entry to any site, and does not guarantee safety of any tagged location.

You access and interact with physical locations at your own risk. LOKA is not responsible for trespass, injury, property damage, or conflicts arising from tagged locations.

9. Open Data and API Access

LOKA may provide public access to content via APIs, publish open datasets, share anonymized or aggregated data, and support public research initiatives. Separate terms will govern API users.

10. Privacy and Data Protection

LOKA intends to comply with the EU General Data Protection Regulation (GDPR) and India's Digital Personal Data Protection Act (DPDP Act).

You consent to public processing of your submitted content, cross-border transfer of data between the United States and India, and AI-based processing.

11. No Warranty

LOKA is provided "AS IS" and "AS AVAILABLE." We make no warranties regarding accuracy, reliability, availability, fitness for a particular purpose, continuous operation, or preservation of data. We do not guarantee that content is truthful or verified.

12. Limitation of Liability

To the fullest extent permitted by law, LOKA and Socratus Collective Wisdom Corporation shall not be liable for indirect, incidental, or consequential damages, lost profits, loss of data, personal injury, property damage, or defamation claims arising from user content.

Our total aggregate liability shall not exceed USD $100. Some jurisdictions may not allow certain limitations; in such cases, liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless LOKA, Socratus Collective Wisdom Corporation, and its officers, directors, and affiliates from any claims arising from your content, your conduct, your violation of law, or your breach of these Terms.

14. Termination

We may suspend, restrict, terminate, or delete accounts or content at any time, without notice. You may delete your account at any time. Licenses granted to LOKA survive termination.

15. Modifications

We may update these Terms at any time. Continued use of LOKA constitutes acceptance of updated Terms.

16. Governing Law and Dispute Resolution

For users located in the United States: Governed by the laws of the United States; binding arbitration under the Federal Arbitration Act; no class actions permitted.

For users located in India: Substantive rights governed by applicable Indian data protection law where mandatory; disputes resolved through binding arbitration seated in the United States; enforcement subject to applicable Indian law.

All users waive the right to participate in class actions or jury trials.

17. Severability

If any provision is found unenforceable, the remainder remains in effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and LOKA.
